Human uterus transplantation is currently under investigation as a treatment for uterine infertility. Without a uterus transplant, the options available to women with uterine infertility are adoption or surrogacy; only the latter has the potential for a genetically related child. UTx will offer recipients the chance of having their own pregnancy. This procedure occurs at the intersection of two ethically contentious areas: assisted reproductive technologies and organ transplantation. In relation to organ transplantation, UTx lies with composite tissue transplants such as (...) face and limb grafts, and shares some of the ethical concerns raised by these non-life saving procedures. In relation to ART, UTx represents one more avenue by which a woman may seek to meet her reproductive goals, and as with other ART procedures, raises questions about the limits of reproductive autonomy. This paper explores the ethical issues raised by UTx with a focus on the potential gap between women's desires and aspirations about pregnancy and the likely functional outcomes of successful UTx. As the price of pharmaceuticals and biologicals rises so does the number of patients who cannot afford them. In this article, we argue that physicians have a moral duty to help patients access affordable medicines. We offer three grounds to support our argument: (i) the aim of prescribing is to improve health and well-being which can only be realized with secure access to treatment; (ii) there is no morally significant difference between medicines being unavailable and medicines being unaffordable, so the (...) steps physicians are willing to take in the first case should extend to the second; and (iii) as the primary stakeholder with a duty to put the individual patient’s interests first, the medical professional has a duty to address cost-barriers to patient care. In articulating this duty, we take account of important epistemic and control conditions that must be met for the attribution of this duty to be justified. (shrink)

Not all forms of human fragility or vulnerability are unavoidable. Sometimes we knowingly and intentionally impose conditions of vulnerability on others; and sometimes we knowingly and intentionally enter into and assume conditions of vulnerability for ourselves. In this article, I propose a presently overlooked basis on which one might evaluate whether the imposition or assumption of vulnerability is acceptable, and on which one might ground a significant class of vulnerability-related obligations. Distinct from existing accounts of the importance of promoting autonomy (...) in conditions of vulnerability, this article offers a preliminary exploration of the nature, role, and importance of resilience promotion, its relationship to autonomy promotion, and its prospects for improving human wellbeing in autonomy inhibiting conditions. This paper urges reconsideration of analyses of the alternatives to reproductive uterus transplantation (UTx). I focus here specifically on the adoption alternative. Importantly, my purpose is not to oppose UTx provision. Rather, it is to propose ways in which ethical analysis and provision of UTx can potentially accommodate the concerns discussed here. I argue that the adoption alternative to UTx is too readily dismissed, and that this is a dismissal with significant moral costs. I suggest that the radical nature of (...) UTx as a form of assisted reproduction calls for an equivalently radical socio‐moral agenda for reform and transformation of adoption law, policy and practice, as well as of the norms that prevail within our presently strongly bio‐normative reproductive context. In doing so I widen the ethical frame of responsible provision of assisted reproduction to encompass not just obligations towards donors and recipient, but also our broader social responsibilities to ensure that we are doing our best to meet the significant needs of some of the most vulnerable members of our society. Human uterus transplantation (UTx)—the most radical and experimental of all current forms of assisted reproduction—gives rise to a range of complex ethical questions, including those related to individual safety, risk, and informed consent. I have argued elsewhere that the wider social impacts and implications of UTx provision must form part of a comprehensive ethical analysis. My socio‐moral critique of UTx provision has been responded to with a number of defences of possible public funding of UTx. In this paper I examine (...) a select number of those defences. These include: that UTx provision would address harms and needs that already exist and as such have priority; that UTx provision is fully compatible with the needed reform of the procreative context in which it would be offered; that UTx provision would not necessarily involve legitimation or endorsement of what are widely agreed to be problematic pronatalist or geneticist norms; and that UTx provision is required as a matter of justice and consistency with other practices. Importantly, defenders are not proposing a ceteris paribus justification of UTx provision; nor do my responses to their arguments represent a comprehensive opposition to UTx. Rather, my more limited purpose here is to show that whatever other defences may be given of publicly funded UTx provision, those considered here do not ultimately succeed and therefore do not allay the concerns underpinning the original socio‐moral critique. Attempts to explain the intuitive wrongfulness in alleged ‘wrongful life’ cases commonly do so by attributing harmful wrongdoing to the procreators in question. Such an approach identifies the resulting child as having been, in some sense, culpably harmed by their coming into existence. By contrast, and enlarging on work elsewhere, this paper explores the relevance of procreative motivation, rather than harm, for determining the morality of procreative conduct. I begin by reviewing the main objection to the harm-based approach, which arises (...) out of Derek Parfit's analysis of the non-identity problem and its implications for preconception cases. Most attempts to avoid the non-identity objection adopt either an impersonal harm approach or draw on some version of a metaphysical modal counterpart theory to defend a person-affecting harm account. But here I develop an alternative view. The proposed account construes the wrongness in the considered cases as ‘evil’ rather than harm, and the type of evil in question as being of a non-grievance, welfare-connected, collective kind. Understanding the wrongness in this way offers a basis for the view that it matters morally why we procreate, and not just whether or how we do so. (shrink)

Successful innovative ‘leaps’ in surgical technique have the potential to contribute exponentially to surgical advancement, and thereby to improved health outcomes for patients. Such innovative leaps often occur relatively spontaneously, without substantial forethought, planning, or preparation. This feature of surgical innovation raises special challenges for ensuring sufficient evaluation and regulatory oversight of new interventions that have not been the subject of controlled investigatory exploration and review. It is this feature in particular that makes early-stage surgical innovation especially resistant to classification (...) as ‘research’, with all of the attendant methodological and ethical obligations—of planning, regulation, monitoring, reporting, and publication—associated with such a classification. This paper proposes conceptual and ethical grounds for a restricted definition according to which innovation in surgical technique is classified as a form of sui generis surgical ‘research’, where the explicit goal of adopting such a definition is to bring about needed improvements in knowledge transfer and thereby benefit current and future patients. Advances in reproductive technologies – in particular in genetic screening and selection – have occasioned renewed interest in the moral justifiability of the reasons that motivate the decision to have a child. The capacity to select for desired blood and tissue compatibilities has led to the much discussed 'saviour sibling' cases in which parents seek to 'have one child to save another'. Heightened interest in procreative reasons is to be welcomed, since it prompts a more general philosophical interrogation of the (...) grounds for moral appraisal of reasons-to-parent, and of the extent to which such reasons are relevant to the moral assessment of procreation itself. I start by rejecting the idea that we can use a distinction between 'other-regarding' and 'future-child-regarding' reasons as a basis on which to distinguish good from bad procreative reasons. I then offer and evaluate three potential grounds for elucidating and establishing a relationship between procreative motivation and the rightness/wrongness of procreative conduct: the predictiveness, the verdictiveness, and the expressiveness of procreative reasons. Increasing philosophical attention has recently focused on questions of the nature of vulnerability, and of the implications of recognizing and responding to vulnerability in human agents and subjects. Within that field of interest, explorations and analyses of the specific vulnerability of children have raised many interesting questions regarding the nature of childhood and the vulnerability-responsive obligations of parents. By contrast, there has been no philosophical recognition or discussion of parental vulnerability within the parent-child relationship. In this paper I seek to (...) address that theoretical gap, exploring the distinct ways in which parents are vulnerable qua parents, as well as some of the normative implications that follow from a recognition of that vulnerability. These implications include claims of a vulnerability-based foundation for extensive parental authority over children, and the significant role of expanded social structures and mechanisms to more adequately support the parenting of our children. OBJECTIVES: This article presents an original definition of surgical innovation and a practical tool for identifying planned innovations. These will support the responsible introduction of surgical innovations. BACKGROUND: Frameworks developed for the safer introduction of surgical innovations rely upon identifying cases of innovation; oversight cannot occur unless innovations are identified. However, there is no consensus among surgeons about which interventions they consider innovative; existing definitions are vague and impractical. METHODS: Using conceptual analysis, this article synthesizes findings from relevant literature, and (...) from qualitative research with surgeons, to develop an original definition of surgical innovation and a tool for prospectively identifying planned surgical innovations. The tool has been developed in light of feedback from health care professionals, surgeons, and policy makers. RESULTS: This definition of innovation distinguishes between variations, introduction of established interventions, and innovations in surgical techniques or use of devices. It can be applied easily and consistently, is sensitive to the key features of innovation, is prospective, and focuses on features relevant to safety and evaluation. The accompanying tool is deliberately broad so that appropriate supports may, if necessary, be provided each time that a surgeon does something "new". CONCLUSIONS: The definition presented in this article overcomes a number of practical challenges. The definition and tool will be of value in supporting responsible surgical innovation, in particular, through the prospective identification of planned innovations. (shrink)

ABSTRACT In previous articles I discussed the ethics of human reproductive cloning, focusing on a possible future scenario in which reproductive cloning can be accomplished without an elevated risk of anomalies to the children who are created. I argued that in such a scenario it would be ethically permissible for infertile couples to use cloning as a way to have genetically related children and that such use should not be prohibited. In ‘Reproductive Cloning and a (Kind of) Genetic Fallacy’, Neil (...) Levy and Mianna Lotz raise objections to my conclusions. They disagree with the view, for which I argued, that some couples can have defensible reasons for desiring genetically related children. They also offer several new arguments against reproductive cloning, including an argument that it would diminish the number of adoptions, thereby adversely affecting the welfare of children who need to be adopted. In this paper I point out that Levy and Lotz's criticisms misconstrue my arguments and that there are serious problems with their arguments for prohibiting infertile couples from using cloning, including their argument from adoption. This article explores the idea of agential multiplicity in medical treatment of childlessness. The analysis illustrates the kinds of agencies that emerge in the use of assisted reproductive technologies. The article begins with a discussion on feelings as participants in IVF treatment and as elements of women’s embodied experience. This is followed by an analysis of three consecutive steps of IVF: ovulation induction, assisted fertilization in the laboratory and embryo transfer. The article aims to show that feminist theory and praxis (...) benefits from empirical analyses of lived bodily experiences as they take form in relation to non-human agencies. Scientists are developing a technique called in vitro gametogenesis or IVG to generate synthetic gametes for research and, potentially, for treating infertility. What would it mean for feminist concerns over the future of reproductive practice and biotechnological development if egg and sperm cells could be produced in laboratory conditions? In this article, I take on the question by discussing the emerging technique of IVG through the speculative feminist analysis of ambiguous reproductive futures. Feminist cultural and science studies scholars have explored (...) the transformative effects of biomedicine on reproduction through science fiction novels and other cultural products. I theorise the speculative and visionary in biomedicine in the context of ethnographic methodology by drawing on ‘thought experiments’ conducted with stem cell scientists as shared acts of future-oriented contemplation. I develop the figure of SF proposed by Donna Haraway to investigate how science facts and speculative fabulation together shape futurities of reproduction. I propose including shifting frontiers in feminist thinking of the SFs in bioscience. Biomedical research aims to shift the borders between what is known and not known in reproductive biology, subsequently raising new technical, ethical and political issues in terms of stratified reproduction. The article shows that synthetic gametes are anticipated to intensify selective procreation. Simultaneously, IVG is seen to forge new biogenetic relationships and possibilities for non-normative reproduction and kin-making. Following Haraway, I argue that by ‘staying with the trouble’ of these biotechnological visions, feminist speculative analytics on technoscience offers a valuable tool to envision more hopeful and equal futures together with scientists. The objective of this study is to examine the contemporary approaches to Da'wah methodology in Malaysia. This study undertook an examination of the impact of social media platforms on conversion rates within the context of the Da'wah methodology. The use of a quantitative approach is implemented through the application of a cross-sectional research design. A questionnaire survey was devised to gather data from Islamic scholars residing in Malaysia. Questionnaires were disseminated to Islamic scholars using social media platforms. A total of (...) 155 valid responses were collected to investigate the impact of social media on conversion rates. The study focused on various factors including content type, frequency of exposure, duration of exposure, and follow-up interactions. The findings obtained from the application of Structural Equation Modelling (SEM) indicate that social media platforms play a significant role in increasing the conversion rate of individuals from different religious backgrounds to Islam. The impact of social media on content type, frequency of exposure, duration of exposure, and follow-up interactions is generally perceived as positive, as it tends to enhance the likelihood of conversion rates. This research holds practical significance for Islamic scholars seeking to enhance conversion rates using diverse social media platforms. (shrink)

In this paper, I first argue that Lucien Goldmann’s attempt to confront Heidegger and Lukács, though it deserves to be revitalized, remains ultimately insuficient. Second, I propose that a more fruitful reading of Heidegger and Lukács should be based on three aspects: first, Lukács’ concept of social totality should be related to Heidegger’s concept of world. Second, the more meaningful way to confront Lukács and Heidegger on the level of praxis is not the everyday dealings with ready-to-hand things, but, instead, (...) the second division of Being and Time in which a political concept of subjectivity and action comes to the forefront. Third, a proper approach to Heidegger’s and Lukács’ philosophies should be based on their respective appropriation of the concept of categories. (shrink)

In this paper we present a model of vocational education and training (VET) that can be used to guide decisions relating to VET in Africa today. This model takes the critique of the neoclassical, neoliberal model of VET as its starting point. Guided by Bhaskar's Critical Naturalism, we use immanent critique to consider the adequacy of proposed alternatives to the neoclassical approach, such as: the heterodox approach, which foregrounds explanations based on human capital and political economy; and Hodgson and Spours' (...) social ecosystem model, which addresses some of the limitations of the heterodox account by including, social and ecosystem elements. Finally, we offer a version of the social ecosystem model that, according to our analysis, explains more of the empirical evidence than previous models. Our version of the social ecosystem model differs from earlier versions in terms of its explicit reference to the critical realist ideas of position- practices and emergence. (shrink)

Southern Africa, where most of these book chapters originate, has been identified as one of regions of the world most at risk of the consequences of environmental degradation and climate change. At the same time, it is still seeking ways to overcome the century long ravages of colonial and apartheid impositions of structural and epistemic violence. Research deliberations and applied research case studies in environmental education and activism from this region provide an emerging contextualized engagement that is related to a (...) wider internationally articulated quest to achieve social-ecological justice, resilience and sustainability through educational interventions. This book introduces a decade of mainly southern African critical realist environmental education research and thinking that asks the question: "How can we facilitate learning processes that will lead to the flourishing of the Earth’s people and ecosystems in more socially just ways?" The environmental education research topics represented in this book are wide-ranging. However, they all exhibit the common theme of social justice and wanting to create change towards a better future. All the authors have used critical realist or critical realist-influenced research methodologies. Offering contributions from a small but growing community of researchers working with critical realism in the global South, this book will be of interest to students, scholars and practitioners in the areas of environmental education, sustainability, development and the philosophy of critical realism in general. Husserl himself understood the principle of a further development in phenomenology as a process of "critique of critique." One can find a realization of this principle in this impressive study by Sonja Rinofner-Kreidl (University of Graz, Austria). Through the title Edmund (...) Husserl.Zeitlichkeit und Intentionalität the author announces her project to be an immanent analysis of central themes in transcendental phenomenology. The study concerns not only an interpretation of the whole published corpus, but also methodological problems and problems of the theory of subjectivity. Phenomenological topics like the lived body or psychology are exlcluded, which is a great advantage of the study. The themes are presented by critical analysis, and with systematic perspicacity in order to give new insights into traditional problems of research in Husserlian phenomenology. The author introduces her main points in three steps. In part one she deals with the "basis of phenomenology" and the "model of intentionality," which are presented in the first chapter through a commentary on the doctrine of intentionality in the Logical Investigations and the Noesis-Noema-correlation in Ideas I. Questions of method such as eidetic intuition and reduction are discussed in the second chapter. Overall, the study tries to understand Husserl's theory as an "intentional neutralism" (684) in which problems of a theory of knowledge are "bracketed." In the two chapters of the second part, the author connects Husserl's theory of subjectivity, the I-problematic and the problem of self-awareness, with his phenomenology of time consciousness. The I-problematic and the different concepts of consciousness in transcendental phenomenology are not only presented through an analysis of the Logical Investigations and Ideas I, but also an explanation of Husserl's later monadology. Rinofner-Kreidl shows convincingly that Husserl's position has to be understood as a non-egological theory of self-awareness.In the third part, the author demonstrates the limits of transcendental phenomenology within metaphysics by critisizing Husserl's thesis of a thinkable "world annihilation" [Weltvernichtung]. The investigation is finished by a chapter on the connection between phenomenology and science.Against the background of such questions, Rinofner-Kreidl develops her main argument against Husserl's phenomenology, namely, that it is able to solve neither the problem of the original temporal constitution of consciousness nor that of the pure I, because of certain methodological preconditions, e.g., intuition and the pure givenness of the phenomena to be described. Both threads are linked together in an impressive discussion of the often discussed reflective problematic. According to Rinofner-Kreidl, the heart of the matter is the question whether acts of reflection have to be understood as inner perception or as re-presentification [Vergegenwärtigung]. By preferring the first option one encounters difficulties by considering the act of reflection as occurring at the same time as the retentional constitution of the lived present. However, on the basis of Husserl's time phenomenology, the latter seems to be impossible. Non-intentional original constitution of time and intentional acts cannot be together at the same "objective" time. Thus, the author speaks about the "neuralgic problem" (511) of Husserl's phenomenology. Further, by preferring the second case one must give up the Cartesian [End Page 160] thread of phenomenology, because a representing reflection must "thematize" its objects, namely the experiences [Erlebnisse] themselves, as an object like any other object. However, this means that phenomenology, which is itself constituted by reflection, is unable "to refer to past objects without errors" (377). Consequently, The Cartesian ideal of an absolute apodicticity has to be given up.The author argues for the second option. She writes: "If a phenomenological philosophy is to keep itself clear of all constitution and speculation by strictly confining itself to the given, then precisely the time analysis comes into conflict with the basic principle, since it wants to describe what never can be an object" (499). His Logical Investigations thematizes the connection between language and logic and his Ideas I thematizes an alternative way of analyzing consciousness and mind. Even his later works such as the Crisis, in which he develops a highly demanding concept of lifeworld and history, seem to have their roots in considerations about problems of (...) science and cognition. An idea is an abstraction; as soon as it becomes applicable to a number of objects or things in the same sense, it is a universal idea. And when he virtually deals with metaphysics, he wants us to consider his statements as hypotheses, or as propositions stated only by the way, and in this department he always wishes "to speak under correction." The contemplated quality remains limited to the particular case; but in its absoluteness it is stripped of all individual, changeable and concrete characteristics. This is the metaphysical universal of the Scholastics. This will make us better acquainted with the nature (...) of the illative sense. I. THE SENSES 1. The External Senses and their Objects. We had already arrived at the conclusion that Newman rejects the mere subjectivity of our knowledge. When he writes about this matter he explicitly deals with sensation or sensuous cognition. Although he takes exception to the word "immediate perception," 1 we may nevertheless call him an adherent of direct or immediate realism according to Scholastic terminology, because he emphatically excludes the intervention of a reasoning process from sense perception and uses the term "mediate perception" only to express the instrumentality of experience. In this meaning our perception of external objects is mediate or indirect indeed.2 The fact is that as early as 1839 he wrote in his University Sermons: "Of the material we have direct knowledge through the senses"3 and in 1843: "The senses are direct, immediate, and ordinary informants, and act spontaneously without any will or effort on our part."4 On the importance of sense perception for our mental activities he writes in a series of hitherto unpublished notes, entitled Elements of Thought:6 "I grant or I assume that the soul would not think without some external stimulus; that if it were cut off from all communication from the external world, it would pass this life in a sort of torpor... CAP.41 Apart from the passages already referred to, Newman nowhere enlarges on the doctrine about the senses. He does not speak about the distinctions between sensible objects; he does not explain the difference between sensation and perception, and uses those terms promiscuously.6 There are no statements on the subject which contradict current Scholastic notions, although sometimes his vague terminology may be an occasion for misunderstandings. For instance, some passages in connection with "images" and "impressions," when read apart from the context, would appear to imply that he identifies them with the Scholastic species a sensibili accepta. McTaggart's ideas on the unreality of time as expressed in "The Nature of Existence" have retained great interest for many years for scholars, academics and other philosophers. In this essay, there is a brief discussion which mentions some of the high points of this philosophical interest, and goes on to apply his ideas to modern physics and neuroscience. It does not discuss McTaggart's C and D series, but does emphasise how the use of derived versions of both his A and (...) B series can be of great virtue in discussing both the abstract physics of time, and the present and future importance of McTaggart's ideas to the subject of time. Indeed an experiment using human volunteers and dynamic systems modelling which was carried out is described, which illustrates this fact. The Many Bubble Interpretation, which also derives from McTaggart's ideas, is discussed and various examples of its use and effectiveness are referred to. The Schrodinger Cat paradox is essentially resolved in principle, the quantum Zeno effect interpretable, Kwiat's recent result referred to, and the newly discovered reverse Stickgold effect described. Various facets of the MBI are discussed, and how it can be used in connection with experimental philosophy, experimental psychology and neuroscience. Brief historical references are given. The large implications of the MBI with regards to McTaggart's paradox and the resolution of the difficulties with quantum mechanics is mentioned. Later sections deal with the mereological fallacy, multiple universes, teletransportation, mind cloning and mind splitting. The WHO Commission on the Social Determinants of Health revealed that there is a 28-year disparity between the life expectancy in the poorest postcode and the richest postcode of Glasgow (CSDH, 2008). There are two sets of questions that it is important to ask about health inequalities like these: first, epidemiological questions about the mechanisms that cause inequalities in health and the measures that are effective in reducing them. Second, normative questions about which inequalities in health are wrong and why (...) they are wrong. The papers in this symposium result from the inaugural conference of UCL's Centre for Philosophy, Justice and Health (CPJH) and focus on the relationship between these epidemiological and normative questions. Historically, scientists in training have learned the rules of ethical conduct by the example of their advisors and other senior scientists and by practice. This paper is intended to serve as a guide for the beginning scientist to some fundamental principles of scientific research ethics. The paper focuses less on issues of outright dishonesty or fraud, and more on the positive aspects of ethical scientific behavior; in other words, what a scientist should do to maintain a high level of ethical (...) conduct in research.There are a number of fairly specific rules, guidelines, or commonly accepted operating principles that have evolved for the ethical conduct of science. In order to discuss this code of ethics, this paper is divided into sections dealing with specific areas of scientific ethics. These areas are: data collection and storage, ownership of data, confidentiality, communication, authorship, collaboration, the peer review system, and rules of dealing with ethical complaints. Illustrative case histories are presented to provide examples of the type of ethical dispute or problem being discussed. If scientific trainees learn the accepted rules of behavior that govern the conduct of science, ethical problems that arise out of ignorance, misunderstanding, or poor communication can be avoided. ABSTRACT In this article we argue for the need to take the moral voices of children and youth seriously particularly in times of the Anthropocene. Drawing on theories in ethics by John Wall, moral development according to Mark B. Tappan, and education in line with the works by Vygotsky, we construct a conceptual framework where the notions ‘narrative,’ ‘moral authorship’ and ‘free will’ can open new creative understandings of human ethical competence; a competence based in a relational, contextual and societal-cultural (...) understanding of human existence. The use of our framework is illustrated in interpretations of empirical research with children demonstrating concerns of theirs in relation to climate change. The article concludes with reflections on the kind of education that can be inspired by this framework and the taking of children’s voices seriously, as well as pointing to challenges also to the grown-up world. _The Contradictions of Modern Moral Philosophy_ is a highly original and radical critique of contemporary moral theory. Paul Johnston demonstrates that much recent moral philosophy is confused about the fundamental issue of whether there are correct moral judgements. He shows that the standard modern approaches to ethics cannot justify - or even make much sense of - traditional moral beliefs. Applied rigorously, these approaches suggest that we should reject ethics as a set of outdated and misguided claims. Rather than facing (...) up to this conclusion, most recent moral philosophy consists of attempts to find some ways of preserving moral beliefs. This places a contradiction at the heart of moral philosophy. As a resilt it is often impossible to tell whether a contemporary philosopher ultimately rejects or endorses the idea of objective right and wrong. On the basis of a Wittgenstein approach Paul Johnston puts forward an alternative account of ethics that avoids this contradiction and recognises that the central issues of ethics cannot be resolved by conceptual analysis. He then uses this account to highlight the contradictions of important contemporary moral theorists such as Bernard Williams, Alasdair MacIntyre, Thomas Nagel and Charles Taylor. (shrink)

Die demografische Entwicklung und der medizinische Fortschritt werden die Problematik der Ressourcenknappheit im deutschen Gesundheitswesen in Zukunft weiter verschärfen. Soll nicht nur kurzfristig akuten Sparzwängen ausgewichen werden, steht – wie in verschiedenen Ländern bereits geschehen – auch Deutschland auf Dauer eine Prioritätensetzung im Gesundheitswesen bevor. Diese sollte in möglichst transparenter Weise nach klaren Kriterien erfolgen. Eines der seit einiger Zeit häufig öffentlich zitierten Kriterien der Verteilung von Mitteln in der Gesundheitsversorgung ist die Eigenverantwortung von Patienten. Deren Berücksichtigung in der Allokation (...) von Ressourcen birgt allerdings zahlreiche Probleme. Der vorliegende Beitrag untersucht die gerechtigkeitstheoretischen Grundlagen und die praktischen Probleme bzw. die möglichen Konsequenzen von Eigenverantwortung als Verteilungskriterium im Gesundheitswesen. Auf der Grundlage eines alternativen gerechtigkeitstheoretischen Vorschlags werden drei Möglichkeiten skizziert, Eigenverantwortung von Patienten im deutschen Gesundheitswesen in gerechter Weise stärker zu betonen. We propose that institutions consider establishing a position of “Ombudsman for Research Practice”. This person would assume several roles: as asounding board to those needing confidential consultation about research issues — basic, applied or clinical; as afacilitator for those wishing to pursue a formal grievance process; and as aneducator to distribute guidelines and standards, to raise the consciousness regarding sloppy or irregular practices in order to prevent misconduct and to promote the responsible conduct of research. Die jüngste höchstrichterliche Rechtsprechung zur Selbstbestimmung der Patienten und zur Normierung medizinischer Handlungen am Lebensende hat eine intensive Debatte ausgelöst. Das Urteil und die akademisch vorgetragene Kritik werden einer grundlegenden medizinethischen Analyse unterworfen. Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen.
